Just as you would not contemplate the purchase of a house without legal advice, so you would be unwise to contemplate the purchase of a Manor without legal advice and you should always appoint an independent solicitor/attorney. Solicitors will be look into whether the person or company selling the Manorial Lordship is in fact the legal owner. ‘Legal owner’ is important in law, and is quite different from a ‘beneficial owner’ ("e.g." a beneficiary under a Will where the legal owner is the Executor or Trustee). A purchaser’s solicitor will also check all Searches to check that the seller is not a bankrupt or (if a company) the solicitor will check companies house register to find where the company is incorporated and will check to see if it has been struck off or in receivership.

Once your offer is accepted, your solicitor will ask the vendor’s solicitor for an Epitome of Title: ie proof of ownership over not less than 15 years (20 years in Ireland). With Manorial Lordships, in Civil Law, title is generally traced back 50 or more years. Proof of ownership is sometimes found in family or estate documents: "Viz." Assents, Probates, Wills, Settlements, Mortgages, Statutory Declarations are common, the latter is supported by persuasive evidence from secondary sources. They are as good as the person making the Declaration and the evidence cite as evidence in documents. The legal wording that will appear in such Conveyances is ‘All and Singular that Manor or Lordship or Reputed Manor or Lordship of Xxxxxxxx, in the parish of Xxxxxxxx, in the County of Xxxxxxxx.’

I became interested in Manorial Property rights, Manorial Research and Manorial Law about 23 years ago, I also have a particular keen interest in the little-known but very important area of manorial rights which has grown in significance in recent years with increasing interest in the law concerning mineral exploitation and renewable energy.

 

I also have a keen passion in all aspects of manorial rights covering and including lordship title, registration issues, valuations, transmission of manors, manorial waste, foreshore and coastal manors, mineral rights and the treatment of manorial rights under the commons registration Act 1965 and the Commons Act 2006.
